Possessing more than 10 pounds can lead to 1 to 5.5 years in prison, along with a $5,000 fine.

Cannabis Laws in New York-Enforcement
Cannabis enforcement in New York has changed considerably in recent years. Adult-use cannabis was legalized in 2021, so adults who are 21 or older may legally possess up to three ounces of cannabis or 24 grams of concentrated cannabis for personal use. Possessing cannabis within these limits is not, by itself, grounds for arrest. New York law also limits the circumstances in which police can use the smell or lawful possession of cannabis as a reason for a search.
That does not mean cannabis can be used anywhere. Smoking or vaping cannabis is prohibited in places where tobacco smoking is banned. Someone who violates these restrictions may face a civil penalty of up to $25 or as much as 20 hours of community service. Cannabis use inside vehicles is also prohibited, and driving while impaired remains illegal.
Possession becomes an offense when the amount exceeds the legal limit. Unlawfully possessing more than three ounces of cannabis or 24 grams of concentrate can result in a fine of up to $125. Possessing more than 16 ounces of cannabis is classified as a Class A misdemeanor. Much larger quantities carry more serious charges: possession of more than five pounds is a Class E felony, while possession of more than ten pounds is a Class D felony.
Selling cannabis without legal authorization is also prohibited. An unlawful sale of any amount may result in a fine of up to $250. Selling more than three ounces, or selling or giving cannabis to someone under 21, may be treated as a Class A misdemeanor. Larger unlawful sales can rise to felony-level offenses.
Police enforcement today is therefore focused less on lawful adult possession and more on illegal sales, possession above permitted limits, underage distribution, impaired driving, and cannabis use in prohibited locations. Adults using cannabis in New York should still pay attention to where they consume it, how much they carry, and whether the cannabis was obtained through lawful channels.
